Montara Water and Sanitary District Finds 1971 Leighton Geologic Report of the Seal Cove-Moss Beach Area ~ Evidence in the Failed 1975 Kopetzke “Takings” Lawsuit Against San Mateo County

Lawsuit: 1975 Kopetzke v. County of San Mateo, Board. of Supervisors. “Since the exercise of police power was proper, it did not constitute a taking and no compensation is due. Chicago, Burlington & Quincy Railway Co. v. Illinois, 200 U.S. 561, 26 S. Ct. 341, 50 L. Ed. 596 (1906). To the extent plaintiffs’ losses result from any inherent geologic defects in their properties, the ancient rule of caveat emptor must apply. And to the extent their losses result from the regulatory activities of the Board based on the geologic findings of the Leighton Report, they constitute the unequal burden which citizens are frequently called upon to bear in the interests of the general welfare. Hadacheck v. Sebastian, supra.

Regular meetings are 7:30pm on the first and third Thursday of each month. They used to held at the District office at 8888 Cabrillo Hwy, next to Pt Montara Lighthouse and Hostel.

Services

Sewer Authority Mid-Coastside (SAM) â€“ MWSD is a member of SAM, the agency that collects and cleans our Coastside community’s wastewater before it enters the ocean. SAM meets monthly on the 4th Monday at 7:30pm. Jim Harvey and Scott Boyd presently serve as SAM board members.

Recology of the Coast â€“ MWSD has contracted with Recology of the Coast for trash pickup, recycling, and waste hauling.

Visit County Solid Waste Department for more information about recycling, composting, etc.
