Half Moon Bay City Council Weighs ADU’s and Measure D Amendment with Coastal Commission Requirements and Housing and Community Development (HCD) Concerns

Receive a presentation and provide direction to staff regarding the process for amending Measure D to exempt or partially exempt accessory dwelling units (ADUs) and related options to further affordable housing production.

 

Next Steps

If the Council were interested in Option 2 (one-half allocation for ADUs), staff would confirm whether the data supports a conclusion that no voter approval is required. This option could also include a variant wherein junior ADUs (JADUs) would be exempt. The justification is that JADUs do not involve new development. Instead, they are located within existing portions of residential units which are modestly reconfigured to establish separation, although they can share a bathroom with the primary residence. In that case, staff would prepare an ordinance for review and recommendation by the Planning Commission, consideration by the Council, and certification by the Coastal Commission.

 

All other options require voter approval. Staff would prepare an ordinance for City Council consideration of placement on the November 2024 ballot. If adopted, it would be forwarded to the Coastal Commission for certification.

 

Staff recognizes that Coastal Commission staff may have the same concerns as raised in the July 2014 staff report. However, the City’s LUP Update has since recognized the need to amend Measure D to accommodate affordable housing. In addition, the Coastal Commission has become more amendable to accommodating affordable housing and for protecting housing stock throughout the Coastal Zone as evidenced in its certification of Half Moon Bay’s Short-Term Rental Ordinance. The Department of Housing and Community Development (HCD) has also advised the City that applying Measure D to ADUs is of great concern. This is an issue included in HCD’s review letter of the City’s draft Cycle 6 Housing Element. Staff would closely coordinate with Coastal Commission staff throughout the process to help ensure a positive recommendation for certification.

The City Council of Half Moon Bay is the City’s governing body, and consists of five elected members. The Council sets priorities and policies, makes final decisions on all major City matters, adopts ordinances and resolutions, appoints the City Manager and City Attorney, and approves the annual budget.

 

The City of Half Moon Bay holds district-based elections for its five city council seats. Each Councilmember is elected to a 4 year term. There are no term limits in Half Moon Bay. The City Council selects one of its members to serve as Mayor and one to serve as Vice Mayor, on an annual basis.
