The proposed agreement includes the following key provisions, which closely track Bob Nisbet’s
City Manager contract:
• Start date: August 20, 2022
• End date: August 19, 2025 (three-year term)
• Base salary of $265,000 per year, with no automatic compensation increase
• One-time $10,000 relocation allowance
• Auto allowance of $500 per month
• $10,000 annual contribution to a 457-retirement plan
• Same medical, dental and vision insurance benefits available to other City employees
• Same CalPERS retirement benefits as is paid for other management employees
• Vacation/sick/administrative leave consistent with management employees
• No severance benefits in the event of termination for “cause”
• In the event of involuntary termination, up to six months of base salary severance pay
• City Manager may resign with 30 days’ notice
The proposed contract includes two additional provisions. First, the City would provide a onetime loan of up to $320,000 to be used solely for a down payment for the purchase of a primary residence for City Manager within San Mateo County. To be eligible for the City Loan, the City Manager must close on the residence within two years. The loan would require a promissory note made by the City Manager payable to the City and secured by a deed of trust on the residence. The down payment loan terms are similar to terms negotiated in city manager contracts with Foster City, Los Altos, and Palo Alto, with the exception that these cities provide loans in a much larger amount (ranging from $1 million to $2.5 million). The proposed down payment loan would be interest free for the first three years, 1 and includes provisions for payment in full in the event of termination, separation or nonrenewal of the contract. Repayment with interest would commence at year three, assuming contract renewal.
Second, the proposed contract provides rights to return to the position of Assistant City Manager within 12 months of the Effective Date so long as (1) the City has not appointed a new Assistant City Manager or begun its recruitment for one and (2) the City Manager was not terminated for cause.
