Subject: Request for Documents Related to Water Main Break and Service Cancellations

Dear Mr. Heldmaier
I hope this message finds you well. In follow up to last night’s meeting and requests from residents I am writing in my capacity as San Mateo County Supervisor for the third district, to formally request documents from Montara Water and Sanitary District, related to recent service issues within the Seal Cove service areas.

Specifically, I am requesting:

  1. All documents, records, reports, communications, photographs, or video related to
    all main breaks that occurred in February and March of 2025.
  2. All documents, notices, internal communications, and correspondence with
    residents related to the cancellation, suspension, or denial of water service for any
    reason from the time period of January 2025 to present.
  3. Any documents or communications reflecting the District’s position that it was not
    obligated to provide service to a resident or residents, to whom it provided service in the
    past, including any non-privileged legal opinions, board communications, or staff notes
    on that subject, from the time period of January 2025 to present.
  4. All documents or communications reflecting the District’s search for locations to hold
    their Board meetings in compliance with the Brown Act open meeting requirements,
    from the time period of January 2025 to present.
  5. All documents evidencing that the District is not legally responsible to maintain sewer
    lines that were formerly maintained by District but are now allegedly the responsibility of
    adjacent private property owners.

This request includes but is not limited to emails, internal memos, staff reports, board minutes, legal analyses, public notices, and any communications with local, state, or federal agencies. Please provide the responsive records electronically, if possible, by July 12, 2025. If there are any issues with fulfilling this request by that date or if there are any questions regarding the scope of the request, please do not hesitate to contact John Nibbelin, County Attorney, at jnibbelin@smcgov.org.

Regular meetings are 7:30pm on the first and third Thursday of each month. They used to held at the District office at 8888 Cabrillo Hwy, next to Pt Montara Lighthouse and Hostel.

Services

Sewer Authority Mid-Coastside (SAM) – MWSD is a member of SAM, the agency that collects and cleans our Coastside community’s wastewater before it enters the ocean. SAM meets monthly on the 4th Monday at 7:30pm. Jim Harvey and Scott Boyd presently serve as SAM board members.

Recology of the Coast – MWSD has contracted with Recology of the Coast for trash pickup, recycling, and waste hauling.

Visit County Solid Waste Department for more information about recycling, composting, etc.
