Half Moon Bay Staff Responds to Warning by Governor, HCD Notice of Violation for Out of Compliance Housing Element, 555 Kelly and ADU Ordinance; State Grant Funding in Jeopardy

3/24/2026: Press Release from HCD listing Half Moon Bay as one 15 cities out of compliance with State Housing Element Law.

Notice of Violation from HCD threatening referral to the State Attorney General if City feils to comply. In Feb. HCD said Element was in compliance with State law, but hold HMB out-of-compliance until we complete rezoning LCP amendment. HCD said to fast track rezoning as City puts out RFP (Request for Proposals) for the Implementation Plan (IP)

4/10/2026: Met with HCD Accountability Staff to discuss Notice of Violation letter and walk thorough schedule for rezoning LCP amendment.

Staff is also preparing a response letter to HCD’s Notice of Violation letter, correcting errors in their notice and a provides a path forward. Written response due on April 23rd, 2026.

HCD now has a draft of the rezoning and is conducting a preliminary review.

4/9/2026: City Council and Staff received a strongly worded letter from HCD regarding the project at 555 Kelly. They expressed strong support and if the current entitlements are not approved, they will hold the City out of Compliance with the Housing Element because 555 Kelly is a “pipeline” project within our Housing Element.

4/17/2026: City Staff will meet with HCD to discuss the letter.

HCD also sent letter notifying the City that the ADU Ordinance is out of compliance with State law and must be updated. The ADU Ordinance is already part of the Implementation Plan update. And informed City ADU Ordinance is out of compliance, the City may not be able to apply the existing ordinance. Will meet with HCD staff 4/15/2026 to discuss their letter. City has until May 9th to respond.

Because HMB’s Housing Element is out of compliance HMB may not be able to qualify for major transportation grants.

The Planning Commission consists of citizen volunteers appointed by the City Council to make decisions or advise the Council on land use and property development issues. The Commission assures that new development is consistent with our Zoning Ordinance, Subdivision Ordinance, long-range General Plan and Local Coastal Plan, State laws and other public policies that advance the interests of our community.
