CONSENT AGENDA. From the Half Moon Bay City Council meeting on Tuesday, April, 16th, 2024 at 7:00pm, as a hybrid meeting.
Staff Recommendation: Adopt a resolution authorizing the City Manager to execute
Amendment No. 7 to the Professional Services Agreement with ELS Architecture and
Urban Design (ELS) for additional construction administrative services for the John L.
Carter Park Improvements Project (CIP No. 0611), increasing the contract by $33,700 for
a new total not-to-exceed the amount of $685,047.
The Parks Master Plan adopted by the City Council on February 5, 2019, identified John L.
Carter Memorial Park (Carter Park) as an opportunity to increase community recreation at an
underutilized City Park. The Park Master Plan specifically identified Carter Park’s potential to
become a “well utilized cultural events park with performances and summer day camps.” While
preparing the City’s FY 2018-19 budget, the Parks and Recreation Commission and residents
expressed desire to consider Carter Park improvements as a priority. City Council accepted this
recommendation and designated the Carter Park Capital Improvement Plan (CIP) project to be a
priority.
The John L. Carter Park Improvements Project includes a new amphitheater including terraced
seating, a new stage with storage space and changing room, a children’s play area, picnic area,
restroom and concession stand building, park access improvements, a nature trail, landscaping,
lighting, and utility improvements.
The City contracted with ELS for the concept and initial design of the project, which received
approval from the Planning Commission in March of 2021. In July 2021, Assemblymember Marc
Berman secured state funding support for the project, which paved the way for the City to
finalize the plans and move forward with construction of the improvements.
On October 19, 2021, the City Council authorized the City Manager to execute Amendment No.
4 to the agreement with ELS to complete permit plans, assist with bidding, and provide support
during construction for a total not-to-exceed amount of $602,072. This was followed by
Amendment No. 5, in the amount of $5,000, to update the construction estimate prior to
construction advertisement.
On July 18, 2023, the City Council authorized the City Manager to execute contract Amendment
No. 6 with ELS for additional design services related to design adjustments that increased
overall resiliency by minimizing flooding impacts on the improvements by $44,274, for a new
not-to-exceed contract amount of $651,346.
On February 20, 2024, the City Council adopted a resolution authorizing the Administrative
Services Director to transfer $1,250,000 from various Capital Improvement Projects to the
Project due to escalated costs related to the delays and other unanticipated project changes.
This approved budget increase also provided a contingency of approximately $622,000 for the
remainder of the construction.
DISCUSSION
As described in the February 20, 2024, Council meeting, the project has been subject to several delays due to unforeseen circumstances, including access constraints, adverse weather delays, and design changes.
With these delays and recent storms, the general contractor now anticipates completion of the Project in August 2024. ELS’s proposal for this amendment provides the necessary design support services through Project completion. Their services are required as the designer of record of the project.

The City Council of Half Moon Bay is the City’s governing body, and consists of five elected members. The Council sets priorities and policies, makes final decisions on all major City matters, adopts ordinances and resolutions, appoints the City Manager and City Attorney, and approves the annual budget.
The City of Half Moon Bay holds district-based elections for its five city council seats. Each Councilmember is elected to a 4 year term. There are no term limits in Half Moon Bay. The City Council selects one of its members to serve as Mayor and one to serve as Vice Mayor, on an annual basis.
