ITEM TITLE: Approval of San Mateo County Multi-Modal Trail Project at El Granada Elementary School

BACKGROUND INFORMATION

CUSD has been working for the past year with staff from the County of San Mateo to plan the proposed building of the portion of the multi-modal trail project serving El Granada Elementary School. The addition of the trail loop serving El Granada Elementary School would be of great benefit to students, families, and staff by providing a new dedicated walking and biking trail loop connecting the school to the proposed multi-modal trail project that will connect El Granada to Half Moon Bay as part of the greater San Mateo County Multi-Modal Trail Project.

CUSD has proposed providing an easement to the County of San Mateo that is necessary for construction of the trail loop serving the school. Under the easement conditions, the County of San Mateo in exchange will assume costs of construction, ongoing maintenance, and ongoing liability for the portion to be built on CUSD property. This will be of benefit to both CUSD and the County.

The school district’s willingness to donate the easement greatly expedites the construction schedule and defrays the county’s construction and maintenance costs and liability risks.

In order to demonstrate to CalTrans that the County of San Mateo has not coerced CUSD to donate the easements, the county has provided a disclosure to CUSD of its rights under Federal Law to receive just compensation for the easement and of CUSD’s right to have an appraisal made of the easement along with an offer of just compensation.

By approving the materials attached here, CUSD waives such rights and thus allows construction to begin significantly earlier: the County is hoping to go out to bid for the construction contract in the spring and to construct the trail over the summer.

In exchange, CUSD will incur no cost for this ongoing benefit. CUSD staff have determined this easement to be in the mutual interest of CUSD and the County of San Mateo, particularly because the property in question is located near Highway 1 and is adjacent to but not located on the existing El Granada Elementary School campus.

Again, these easement documents provide clear, explicit, and robust protections and assurances to CUSD: in exchange for the easement and its donation of unused property, the County of San Mateo will take responsibility for all construction costs and all maintenance costs as well as assuming ongoing liability for use of the trail by the County and the Coastside public.

FISCAL ANALYSIS There is no financial impact to the General Fund as the County of San Mateo assumes all related costs.

RECOMMENDATION CUSD staff recommends approving these materials to provide an easement at no cost to the County so that El Granada students and families can walk and roll to school safely. This is good for community members and their safety for walking, running, and biking while not costing CUSD anything. CUSD has negotiated with the County so they assume all the costs of construction, ongoing liability, and ongoing maintenance in exchange for us granting an easement of this property that is not currently used by CUSD or El Granada Elementary School.
