U.S. Supreme Court To Hear Donor Disclosure Cases, The NonProfit Times

After winding its way through California courts during the past half-decade or more, a case involving donor disclosure requirements ultimately will be heard by the U.S. Supreme Court this spring.
The nation’s top court consolidated two cases brought against the California Attorney General by the Thomas More Law Center and Americans for Prosperity Foundation. The Supreme Court granted certiorari in Thomas More Law Center v. Becerra (Docket No. 19-255) on Jan. 8.
U.S. Supreme Court Accepts KDV First Amendment Case
Today, the U.S. Supreme Court granted KDV’s petition to hear a free speech and assembly case brought by its client, the Thomas More Law Center, against the California Attorney General (the “A.G.”). The case arises from a demand by the A.G.’s office that all nonprofit charities that are active in the state turn over their list of significant donors. It is the first KDV case that will be heard by the high court.
San Francisco partner Louie Castoria filed and handled the case at the trial level, arguing that strict scrutiny must be applied to state laws that seek to compel member or donor lists, in keeping with Supreme Court decisions in the 1950s in favor of the NAACP, and finding that states may not compel such disclosures. The trial court granted a permanent injunction against the A.G., though the Ninth Circuit Court of Appeals overturned the judgment, setting the scene for KDV’s request that the Supreme Court hear the case.

We are a community radio station serving Pescadero, CA and the South Coast. We are a 501c3 non-commercial, and listener-sponsored station. The station provides access to local DJ hosted shows ranging from public affairs, news, music programming, and emergency service announcements, both locally and nationally sourced. KPDO also has volunteers in the local school district to provide medial learning opportunities to local students.
Pescadero Public Radio Service (PPRS) has developed community support and good relationships with the La Honda Pescadero Unified School District, local nonprofits, and community leaders. Our most important purposes are:
– Youth Broadcast Journalism at Pescadero Schools
– Emergency Communications for Pescadero and the Southcoast
– Locally run and operated Community News and Entertainment
In order to meet our goals we have developed Youth Broadcast Journalism classes, developed procedures and protocols for the radio station in the event of emergency, recruited DJ’s and trained them to provide local news and entertainment, and have met all FCC req
uirements and received approvals for the legal operation of the Station, including approval of the Radio Frequency, the antenna site (currently approved on Reservoir Road), and the power, 100 watt.
